Data Processing Agreement (DPA)
Version 1.0 — 21 October 2026 · under Article 28 GDPR
This agreement governs how PartyBooth AI processes, on behalf of the Operator, the images of the people photographed at the Operator's events. It supplements the Terms of Service and License Agreement and the Privacy Policy, and it is accepted together with the Terms when the license is activated. If the Terms and this agreement conflict on processing on behalf of the Operator, this agreement prevails.
1. Parties and roles
- Controller: the Operator (photographer, photo booth company or event company) who uses PartyBooth AI and decides why and how guests' photos are processed.
- Processor: Gian Marco Elti di Rodeano, sole proprietorship, VAT IT07626701002, Loc. Piana Sant'Angelo, 66050 San Salvo (CH), Italy ("PartyBooth AI"), who processes the photos only on behalf of the Operator.
2. Subject, duration, nature and purpose
| Subject | AI effects and background change on photos chosen at the booth; texts of the AI Frame written from the photo and the event description; delivery of photos and videos to guests via QR code; live projection of the event photos on a screen, when the Operator turns it on. Shooting, framing, printing and the event archive run locally on the Operator's PC and are not processed by PartyBooth AI. |
| Duration | For the term of the license; each image only for the time set out in §7. |
| Nature | Automated image processing and temporary storage for delivery and projection. |
| Purpose | Delivering the features of the software that the Operator uses at the event. |
| Types of data | Images of faces (common data: PartyBooth AI detects faces to frame them, it does not identify people); AI-generated images and texts; event name, and the Operator's name and logo shown on the guest page and on the projection screen. |
| Data subjects | Guests photographed at the Operator's events, including minors. |
3. Instructions
PartyBooth AI processes the data only on the Operator's documented instructions. Using the software according to its documentation is a documented instruction. PartyBooth AI informs the Operator if, in its opinion, an instruction infringes data protection law.
4. Confidentiality
Persons authorised to process the data are bound by an appropriate duty of confidentiality.
5. Security (Article 32 GDPR)
- Images are sent over encrypted connections (TLS).
- Photos stay on the Operator's PC; they reach our services only when the Operator uses an AI feature, QR delivery or the live projection.
- The projection page is protected by a 6-digit PIN with a limit on attempts and is not indexed by search engines.
- Images are never used to train AI models.
- Access to systems is restricted to the processor.
6. Sub-processors
The Operator authorises PartyBooth AI to engage the sub-processors below. PartyBooth AI binds them to data protection obligations equivalent to this agreement and remains responsible for them. PartyBooth AI informs the Operator by email in advance of any change, giving the Operator the opportunity to object.
| Sub-processor | Activity | Location |
| Cloudflare, Inc. | Hosting, AI request handling, temporary storage for QR delivery and projection | USA / global network |
| Aruba S.p.A. | Application servers and database (licenses, guest page); no guest images stored | Italy |
| Google LLC (Gemini) | AI image effects | USA |
| fal.ai Inc., and through it OpenAI and xAI for the effects that use their models | AI image effects | USA |
| Replicate, Inc. | AI image effects | USA |
| Anthropic PBC | Texts of the AI Frame | USA |
7. Deletion
- AI processing: the image passes through the providers only for the seconds of processing, except for any temporary retention under the providers' own policies.
- QR delivery: the file stays available while the link is valid, 6 hours by default, and is then deleted.
- Live projection: photos are deleted when the projection ends or the program is closed, at the latest within two days if the program closes abnormally; with the QR option on, they stay 6 hours. The event name and the Operator's name and logo are deleted after 7 days.
On request, PartyBooth AI confirms the deletion in writing.
8. Assistance
Taking into account the nature of the processing, PartyBooth AI assists the Operator in answering data subject requests (Articles 15–22 GDPR) and with security, breach notification and impact assessments (Articles 32–36 GDPR). Because images are deleted quickly, most requests are handled by the Operator, who keeps the photos on their own PC.
9. Personal data breaches
PartyBooth AI notifies the Operator without undue delay after becoming aware of a personal data breach affecting the images processed on its behalf, with the information the Operator needs to inform the supervisory authority and the data subjects.
10. Transfers outside the EU
Where a sub-processor processes data outside the European Economic Area, the transfer relies on the European Commission's Standard Contractual Clauses or another adequate safeguard (Articles 44 et seq. GDPR), such as the EU-US Data Privacy Framework for certified companies.
11. Audits
PartyBooth AI makes available the information needed to demonstrate compliance with Article 28 GDPR and allows audits by the Operator or a mandated auditor, with reasonable notice and respecting confidentiality.
12. Minors and guest information
Informing guests, displaying a notice at the event and, for minors, obtaining the consent of whoever has parental responsibility are the Operator's duties as Controller. PartyBooth AI processes such images with the same safeguards as §5.
13. Governing law
Italian law applies; for business-to-business disputes the court of Vasto (CH) has jurisdiction. This agreement is drafted in Italian; the Italian version prevails for Operators established in the European Union and the English version for those established outside it.

12. Minori e informativa agli ospiti
Informare gli ospiti, esporre un'informativa all'evento e, per i minori, raccogliere il consenso di chi esercita la responsabilità genitoriale spettano all'Operatore in qualità di Titolare.
